the police. what's the latest there? >> you can see crime tape is still up. just down the street is the crime scene. this is what we know right now. the san jose police respond to a call to an unknown disturbance this morning. police pulled up to the 1200 block of oxton drive and found a man shot dead. that person was inside the garage. we've also learned there were three other victims. those victims were shot at that same house. we learned they were attending some type of gathering, those four young men were attending a gathering. the suspects had already left the scene by time police arrived. minutes later, police found out those other three had walk into several other hospitals in san jose, each suffering from gunshot wounds. one of the victims is already. the other two we've learned were treated. no word on their condition.

the campus of low has ma vista -- loma vista elementary. school is out for the summer, so we don't expect to see anybody here this morning. ktvu is the only station of videotape of the suspect. 56-year-old jerry johnson was arrested at his home in elk grove around 5:30. he was then brought to vallejo. this is video of johnson being detained by -- by police. >> he didn't seem too knock -- too shocked by arrest. it's a heinous crime. >> reporter: johnson is being held on a $750,000 bond. police say johnson is not currently registered as a sex offender in this state. police say johnson teaches developmentally disabled kids between the ages of -- between

ages of 3 and 5. the victim is 18. she also attends school at hoe ma vista. police say even though the victim is 18, her mental capacity makes it impossible for her to give consent for such an intimate act. because her mental disability she's unable to give consent even though she's 18 to have sex with an adult. >> reporter: police say johnson has worked here for two years. right now, it's not clear if the school knows about the arrest. there's no sign on the school's website 0 or the district's -- website or the district's website about the arrest. police say this happened in february. we're trying to it find out why, then, did it take so long for the allegations to be brought forward, and what, if any, physical evidence still remains. kraig debro, ktvu channel 2

news. 7:04. an early-morning fire in san francisco leaves one person homeless right now. fire started about 1:00 at an apartment building on elm street between pierce and scott. now, when firefighters arrived, they found the fire burning in between two buildings and -- and that forced them to call in a second engine. that fire is under investigation. >> we're waiting for the arson squad to show up and rule out the areas where they can start overhauling and determine the cause. >> no one was hurt. housing is being made available for one person. somebody broke a window at the wells fargo bank on california street around 1:00 a.m. and then set newspapers on fire that were inside the bank beneath the window sill. this is the second time in two weeks that newspapers were set

on fire in a san francisco building. in about 90 minutes, america's first lady will be in berkeley. michelle obama will attend a breakfast event at the claremont hotel organized by super-star chef, alice waters. later, she will attend a pricey lunch and then in the financial district, first lady is in -- district. the first lady is in california to help raise money for her husband's campaign. she aended -- attended a function in beverly hills last night. republicans say the first lady is spending tax payer money to pay for her fund-raising trip. and today, president obama's stop on the u.s. island territory of puerto key row -- rico. they've become a powerful

bay. sonoma coast is mostly fog- free. inland, no fog to deal with. not too much. sunny, warmer highs, well inland, near 90. new this morning the u.s. military has announced the death of two american soldiers conducting operations in southern iraq. no details were given and the soldiers have not been identified. the u.s. has stepped up attacks with the approach of the year and the withdrawal of the troops. eight troops in iraq have been killed this month. last night, seven republican presidential candidates faced off in new hampshire. as alison burns reports from our washington, d.c. newsroom, they were all focused on one message. alison. >> reporter: it was the national debut for some of the candidates. others had been on the presidential debate stage before. they did not spend much time attacking each other but instead focused on beating president obama. >> this president has failed.

compensation plan for tens of thousands of people who have been affected by the nuclear disaster there. now, under the plan, the victims would get payments from $124 billion fund. that money would be repaid by tepco in a number of years there's word that six more plant employees have exceeded the radiation exposure limit. it is 7:22. there is now word that a half brother of convicted killer yusuf bay iv was released from jail this weekend. joshua bay spent nearly four years in custody as part of a plea bargain. he had agreed to testify against bay iv to avoid a possible life sentence. josh had been arrested for rape and torture of two women at a house in east oakland.

welcome back. 7:27. and right now as we speak, police in san jose are investigating a shooting that left one man dead, three others wounded. ktvu's jade hernandez has arrived there. she's right near the home where the shooting happened. good morning, jade. >> reporter: good morning. we can show you this morning that several squad cars and the crime scene is about a block away. you can see the command center right there with the information we've just learned, we can better describe details. san jose police are keeping us about a lock away from home where police say -- about about a block away from home where police say shots were fired. police say four young men had gathered inside of the garage. at this point, police believe several suspects walked you and opened fire right here in the 1200 block of oxton tribe. by time police arrived, they found only one body inside of the garage. the other three men made their way to two other local hospitals. police say they will survive

their injuries. we're definitely looking into all angles or aspects if, if you will, to determine if this was gang-related or if it was just a heated dispute. we really don't know. at this point, police don't have a motive. detectives are still trying to determine if this is gang- related. but they say the four victims that they had were not -- they do not believe were suspects in this the shooting. right now, they have one young man who was shot to death. three others who were shot and they still don't have a motive in the shooting but, of course, all of this is under investigation right now. reporting live from san jose, jade hernandez, ktvu channel 2 news. 7:29. 14 people are homeless this morning after a fire broke out in a san leandro apartment building. it start yesterday around 6:0 p.m. in a 66-unit building around haze and thornton -- hayes and

agent because he's deemed low risk. his parole is scheduled to end in one year. he served 11 months of a two- year sentence and received early release thanks to a year of conduct credit, there was no word on where he plans to live next. meanwhile, his legal troubles are not over yet. oscar grant's family has filed a multi-million dollar lawsuit against the officer. and the case is being reviewed to see if it warrants federal charges. some plaintiffs claim they were arrested unlawfully and mistreated during a protest

he snuck into the house and started raping woman at knife point. but during the attack, he said he didn't feel well, rolled over and died. now his body is undergoing an automobile -- autopsy. the man was on parole after serving his sentence for sexually assaulting a child. in florida, state prosecutors are close to wrapping up their murder case against alleged child killer, casey anthony. the proceedings ended early because one of the state's witnesses was unavailable until this afternoon. that's when today's session will start. it's not clear exactly who the state intends to call. prosecutors may wrap up tomorrow which means the defense could begin on thursday. casey anthony is accused of suffocating her 2-year-old daughter caylee and faces the death penalty if convicted. we will bring you a live report from the courthouse in in orlando on what to expect in

today's proceedings. nine minutes before 8:00. five boys from a san mateo middle school are now facing felony charges. investigators say they tried to rape two gills during a field trip. the boys are all 7th graders at kennedy middle school. investigators say the attack took place last march while 0 students were visiting a park in nearby redwood city. two chaperons, a teacher and the teacher's assistant were all there to suppervice.
